Welcome to PackCleared. These Terms of Service (“Terms”) govern your access to and use of the PackCleared website, applications, and services (collectively, the “Service”). By creating an account, using the Service, or clicking through an agreement that references these Terms, you agree to be bound by them. If you're using PackCleared on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
PackCleared's privacy practices are described in our Privacy Policy, which is incorporated by reference into these Terms.
1. Accounts
You must be at least 13 years old to create a PackCleared account, or the minimum age specified by applicable law in your jurisdiction. Children under 13 may use PackCleared only through an organization account (such as a school) with verifiable parental consent obtained by the organization under applicable law.
You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
You agree to provide accurate account information and to keep it current. You may not create an account using false information, use another person's identity without authorization, or use the Service to impersonate any person or organization.
2. Plans, passes, and billing
PackCleared offers a free tier for individual users, one-time Trip and Event Passes for casual group organizers, and recurring subscription plans for organizations. Current pricing is shown on the PackCleared pricing page and may change from time to time on reasonable notice to existing subscribers.
Paid plans are billed in advance on a recurring basis (monthly or annual, depending on the plan). You authorize us to charge your payment method for all applicable fees, taxes, and authorized charges. Fees are non-refundable except where required by law or explicitly offered (for example, a published money-back guarantee).
You may cancel a recurring plan at any time from your workspace billing settings. Cancellation takes effect at the end of the current billing period; you retain access until that date.
Payment processing is handled by Stripe, Inc. under their terms. We never store your payment card details.
3. Your content
You retain ownership of the content you create or upload to PackCleared — your trips, Packlists, Kit items, photos, profiles, and any other information you contribute (“Your Content”).
To operate the Service, you grant PackCleared a limited, non-exclusive, worldwide, royalty-free license to host, copy, process, display, and transmit Your Content as necessary to provide the Service to you and to the people you explicitly share with. This license ends when you delete Your Content or close your account, except to the extent PackCleared is required to retain records for legal, audit, or backup purposes.
We do not use Your Content to train AI models for the benefit of other users. Inference on Your Content (for example, generating packing suggestions) is a service we provide to you.
4. Acceptable use
You agree not to use the Service to:
- Harm or endanger minors. Do not use PackCleared to contact, groom, coerce, or share adult content with anyone under 18.
- Harass, threaten, or discriminate against other users, PackCleared staff, or any third party. This includes targeted harassment, hate speech, and incitement to violence.
- Violate laws applicable to you, your trip destination, or our service. You are responsible for compliance with export controls, sanctions, travel restrictions, and any other laws that apply to your activities.
- Infringe intellectual property rightsof PackCleared or others. Don't upload copyrighted content you don't have rights to, and don't scrape or copy substantial portions of the Service.
- Disrupt the Service. No denial-of-service attacks, load testing without permission, credential stuffing, scraping at abusive rates, or attempts to circumvent rate limits, access controls, or security features.
- Probe or attack the Service or any connected system. Security research is welcome through coordinated disclosure described on our security page; non-coordinated testing is prohibited.
- Misrepresent your identityor the source of content. Don't spoof, phish, or use PackCleared to impersonate others.
- Use the Service for spam — unsolicited email, trip invitations, or messaging outside the organic invitation flow PackCleared provides.
- Bypass content controls. Do not attempt to circumvent age verification, minor-protection floors, organization policy settings, or the tier-aware adult content gate.
- Resell or redistribute the Service without our written permission.
- Build a competing product using data, APIs, or access you obtain through the Service.
We may investigate suspected violations. Depending on severity, we may warn you, limit features, suspend your account, or terminate service. For violations involving harm to minors, illegal activity, or active abuse, we may suspend immediately and without notice.
5. Organization use
When PackCleared is used by a school, business, or other organization, the organization itself is responsible for:
- Obtaining any consent required by law from Packers or their parents/guardians (including under COPPA, FERPA, GDPR, or state student-data-privacy laws).
- Configuring appropriate privacy and safety settings (including minor-safety mode where applicable).
- Managing Packer access and removing departed Packers promptly.
- Deciding what information to share within and across trips.
PackCleared provides the architecture to enforce these decisions (see trust page for detail), but the organization owns the decisions.
6. AI-generated suggestions
PackCleared uses AI to generate packing suggestions based on your trip context, profile, and history. AI-generated suggestions are informational only and may contain errors, omissions, or inappropriate content. You remain responsible for what you actually pack — particularly for safety-critical items (medications, medical devices, adaptive equipment, travel documents). Verify AI suggestions against your own judgment and, where appropriate, the advice of a qualified professional.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” PACKCLEARED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PACKCLEARED AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF PACKCLEARED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (a) THE FEES YOU PAID PACKCLEARED IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED US DOLLARS.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities; in those jurisdictions, our liability is limited to the maximum extent permitted.
9. Termination
You may close your account at any time from account settings or by contacting us. We may suspend or terminate your account for material violations of these Terms, extended non-payment, suspected fraud, or where required by law.
Upon termination, your right to use the Service ends immediately. We will retain account data per the retention policy described in our privacy policy. Provisions of these Terms that by their nature should survive termination will survive (including intellectual property rights, disclaimers, limitations of liability, and dispute resolution).
10. Changes to these Terms
We may update these Terms from time to time. If a change materially reduces your rights, we will notify you via your account email or in-app notice before the change takes effect. Your continued use of the Service after the change becomes effective constitutes acceptance. If you do not accept the change, stop using the Service and close your account.
11. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any dispute arising from or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
If you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction that grants mandatory consumer protections, nothing in these Terms limits those rights. Mandatory local law applies.
